Do you think selling a home as-is means the buyer gets it no questions asked? Many people in Louisiana believe that as-is means what you see is what you get. But that is not the full story.
Let’s break down what the as-is clause really means and how it affects buyers and sellers in a simple, clear way.
What the as-is clause really means in Louisiana. In Louisiana, the “as-is” clause in a purchase agreement does not prevent the buyer from inspecting the property or asking for repairs. Louisiana operates under the caveat emptor (buyer beware) principle, meaning the buyer has the right to inspect before fully committing.
The as-is clause signifies that the property is sold in its current condition, but inspections are permitted during the inspection period.
Buyers still have the right to inspect. In an “as-is” sale, buyers can still schedule inspections and ask the seller for repairs or a repair allowance if problems are found. The seller can agree to fix issues, offer money, or decline. Everything remains negotiable; the “as-is” clause only establishes the starting point.
Full waiver of warranty and disclosures. An “as-is” clause usually includes a full warranty disclaimer, meaning the buyer accepts the property in its current state and won’t hold the seller responsible for certain hidden problems. However, sellers are still legally required to disclose known defects. The clause does not allow sellers to hide serious issues and does not mean the buyer waives all protections; it simply confirms the sale is based on the home’s present condition, with inspections and negotiations still possible.
How as-is affects real estate transactions. In real life, most Louisiana home sales with an as-is clause still involve inspections and discussions about repairs. Buyers inspect. Sellers respond. Both sides negotiate. The key is understanding that as-is is about condition, not about removing rights.
Buyers protect themselves through inspections, sellers through proper disclosures, and both can negotiate an agreement that works for everyone.
